(together with our affiliates, “Patlytics”, “we”, “our” or “us”) respect your privacy and are committed to keeping secure any information we obtain from you or about you.This privacy policy (“Privacy Policy”) describes our practices with respect to PersonalInformation we collect from users (“user”, “you”, or “your”) of our website and services(collectively, “Services”). This Privacy Policy applies to any visitor to or user of our Services.This Privacy Policy does not apply to content that we process on behalf of Customers (defined below) of our business offerings.

Scope and Applicability

Data protection laws distinguish between entities that control the purposes and means of processing information and entities that process information on behalf of other entities. The terms and conditions of our customer agreement (“Customer Agreement”), governs our provision of Services to our business customer (“Customer”). When we process Personal Information on behalf of a Customer to provide contracted Services, we do so in accordance with the terms of the Customer Agreement and the Customer's instructions, not this Privacy Policy. If you wish to exercise your rights regarding Personal Information we are processing on behalf of a Customer, you should contact the applicable Customer for assistance, and we may forward communications we receive from you to the Customer for resolution. We are not responsible for the privacy practices of our business customers, which may differ from those in our Privacy Policy.

Personal information we collect:

We collect information that alone or in combination with other information in our possession could be used to identify you (“Personal Information”) as follows:

Personal Information you Provide

Account Information: When you create an account with us, we will collect information associated with your account, including your name, contact information, account credentials (collectively, “Account Information”).

Customer Content: When you use our Services, we may collect Personal Information that is included in the input, file uploads, or feedback that you provide to our Services. Such information is considered “Customer Content” as defined in our Terms and Conditions.

Communication Information: If you communicate with us, we may collect your name, contact information, and the contents of any messages you send (“Communication Information”).

Social Media Information: We may have pages on social media sites like Instagram, Facebook, Medium, Twitter, YouTube and LinkedIn. When you interact with our social media pages, we will collect Personal Information that you elect to provide to us, such as your contact details (collectively, “Social Information”). In addition, the companies that host our social media pages
may provide us with aggregate information and analytics about our social media activity.Other Information: We receive other information from you when you choose to interact with us in other ways, such as if you sign up for one of our webinars or newsletters or participate in a research study or event.

Business Contact Information: If you are a business representative, we collect your information in connection with the performance of the Customer Agreement or potential agreement with us. This information may include your first name, last name, company contact information (e.g., email, phone, address), job title, billing and payment information and any other information related to the performance of the agreement with us.

Personal Information We Receive Automatically From Your Use of the Services:

When you visit, use, and interact with the Services, we may receive the following information about your visit, use, or interactions (“Technical Information”):

Log Data: Information that your browser automatically sends whenever you use our website (“log data”). Log data includes your internet protocol address, browser type and settings, the date and time of your request, and how you interacted with our website.

Usage Data: We may automatically collect information about your use of the Services, such as the types of content that you view or engage with, the features you use and the actions you take, as well as your time zone, country, the dates and times of access, user agent and version, type of computer or mobile device, computer connection, IP address, and the like.

Device Information: Includes name of the device, operating system, and browser you are using. Information collected may depend on the type of device you use and its settings.

Analytics: We may use a variety of online analytics products that use cookies to help us analyze how users use our Services and enhance your experience when you use the Services.

Personal Information We Receive from Other Sources

We may obtain information from other sources, including, but not limited to, publicly available sources, third-party data providers, brand partnerships, and third-party integrations you consent to, or through transactions such as mergers and acquisitions. We may combine this information with other information we collect from or about you.

How we use personal information:
We may use Personal Information for the following purposes:

  • To provide, administer, maintain and/or analyze the Services;
  • To improve our Services and conduct research;
  • To verify your identity or the identity of the Customer wishing to use the Services;
  • To determine the availability of Services offerings and maintain your account;
  • To communicate with you;
  • To develop new programs and services
  • To send you information including confirmations, invoices, technical notices, updates,security alerts, and support and administrative messages;
  • To analyze how you use the Services with tools such as Google Analytics and other toolsto help us understand traffic patterns and know if there are problems with the Services;
  • In connection with a merger, acquisition, reorganization or similar transaction;
  • To prevent fraud, criminal activity, or misuses of our Services, and to ensure the securityof our IT systems, architecture, and networks;
  • To comply with legal obligations and legal process and to protect our rights, privacy,safety, or property, and/or that of our affiliates, you, or other third parties; and
  • At your direction nor instructions, or for any purpose with your consent.

Aggregated or De-Identified Information.

We may aggregate or de-identify Personal Information and use the aggregated information to analyze the effectiveness of our Services, to improve andadd features to our Services, to conduct research and for other similar purposes. In addition, from time to time, we may analyze the general behavior and characteristics of users of our Services and share aggregated information like general user statistics with third parties, publish such aggregated information or make such aggregated information generally available. We may collect aggregated information through the Services, through cookies, and through other means described in this Privacy Policy. We will maintain and use de-identified information in anonymous or de-identified form and we will not attempt to reidentify the information.We use cookies and other tracking technologies to help us collect and process TechnicalInformation. Please see the “How Do We Use Tracking Technologies” section below for more information.

How We Disclose Personal Information

In certain circumstances we may provide your Personal Information to third parties without further notice to you, unless required by the law.

Vendors and Service Providers: To assist us in meeting business operations needs and to perform certain services and functions, we may provide Personal Information to vendors and service providers, including providers of hosting services, cloud services, and other information technology services providers, event management services, email communication software and email newsletter services, and web analytics services. Pursuant to our instructions, these parties will access, process, or store Personal Information only in the course of performing their duties to us.

Business Transfers: If we are involved in strategic transactions, reorganization, bankruptcy, receivership, or transition of service to another provider (collectively a “Transaction”), your Personal Information and other information may be disclosed in the diligence process with counterparties and others assisting with the Transaction and transferred to a successor or affiliate as part of that Transaction along with other assets.Affiliates: We may disclose Personal Information to our affiliates, meaning an entity that controls, is controlled by, or is under common control with Patlytics. Our affiliates may use the
Personal Information we share in a manner consistent with this Privacy Policy.

Customers: We disclose Personal Information contained within Customer Content with the applicable Customer to provide Services on their behalf. For example, we may disclose information to the Customer to provide Services, report on your use of the Customer’s account, respond to your and their questions, comply with your and the Customer’s requests, and otherwise comply with the law. In addition, the Customer can assign different roles to authorized users, which will have different associated capabilities and permissions and we will disclose information about your use of the Services to other authorized users in accordance with such permissions. Our Customers are independent entities and their processing of information is
subject to their own policies and terms.

Third Party Services: We may disclose your Personal Information with third party services and their providers if you or the Customer uses third party services in connection with the Services.

Legal Requirements: We may disclose your Personal Information (i) if required or permitted by applicable law or regulation, including laws and regulations of the United States and other countries, (ii) in the good faith belief that such action is necessary to comply with a legal obligation or in response to a request from law enforcement or other public authorities wherever we may do business; or (iii) protect and defend the rights or property of Patlytics.

Other Situations: We may disclose your Personal Information to (i) act in urgent circumstances to protect the personal safety of users, Customers, and contractors/employees of Patlytics or others; (ii) prevent fraud, (iii) maintain the security of the Services; or (iv) enforce our Terms and Conditions or otherwise protect against any legal liability.

With your Consent: We may disclose your Personal Information at your direction or instructions, or for any purpose with your consent.

Cookie Policy

Some of the features on the Services may require the use of “cookies” - small text files that are stored on your device’s hard drive. We use Cookies to enable our servers to recognize your web browser and tell us how and when you visit and use our Services, to remember your preferences, analyze trends, learn about our user base, provide relevant advertising, and operate and improve our Services. We may supplement the information we collect from you with information received from third parties, including information collected using third party cookies. Managing Your Privacy

All users may request to review, update, correct or delete the Personal Information furnished bya user in their user account by contacting us at support@patlytics.com or by accessing your user account. For your protection, we may only share and update the Personal Information associated with the specific email address that you use to send us your request, and we may need to verify your identity before doing so. We will try to comply with such requests in a reasonably timely manner. If you wish to review, update, correct or delete Personal Information contained in Customer Content or cancel your account, please reach out to the applicable Customer to do so. We may use some of the information we collect for marketing purposes, including to send you promotional communications about new features, products, events, or other opportunities. If you wish to stop receiving these communications or to opt out of use of your information for these purposes, please follow the opt-out instructions, such as clicking "Unsubscribe" (or similar opt-out language) in those communications. You can also contact us at support@patlytics.com to opt out. Despite your indicated email preferences, we may send you service-related communications, including notices of any updates to our terms and conditions or privacy policy.

Children Under 16

Our Services are not directed to children who are under the age of 16. Patlytics does notknowingly collect Personal Information from children under the age of 16. If you have reason tobelieve that a child under the age of 16 has provided Personal Information to Patlytics throughthe Services please email us at support@patlytics.com. We will investigate any notification andif appropriate, delete the Personal Information from our systems. If you are 16 or older, butunder 18, you must have consent from your parent or guardian to use our Services.

Links to other websites

The Services may contain links to other websites not owned, operated or controlled by Patlytics, including social media services (“Third Party Sites”). This Privacy Policy does not apply to theThird Party Sites. This means that this Privacy Policy does not explain what our Customers do with your information that we provide to them or any information they collect directly from you and submit to us. Information provided by or to third parties, such as our Customers, are controlled by their respective privacy policies, which we encourage you to review for more information about their practices.

How We Respond to Do Not Track Signals

Your browser settings may allow you to automatically transmit a Do Not Track signal towebsites and other online services you visit. We do not alter our practices when we receive a DoNot Track signal from a visitor’s browser because we do not track our visitors to provide targeted advertising. Security and Retention

We implement commercially reasonable technical, administrative, and organizational measures to protect Personal Information both online and offline from loss, misuse, and unauthorized access, disclosure, alteration, or destruction. However, no Internet or email transmission is ever fully secure or error free. In particular, email sent to or from us may not be secure. Therefore, you should take special care in deciding what information you send to us via the Services or email. In addition, we are not responsible for circumvention of any privacy settings or security measures contained on the Services, or third party websites.We will retain your Personal Information for only as long as we need to in order to provide ourServices to you, or for other legitimate business purposes such as resolving disputes, safety and security reasons, or complying with our legal obligations. How long we retain PersonalInformation will depend on a number of factors, such as the amount, nature, and sensitivity of the information, the potential risk of harm from unauthorized use or disclosure, our purpose for processing the information, and any legal requirements.Please note that we may retain information that is otherwise deleted in anonymized and aggregated form, in archived or backup copies as required pursuant to records retention obligations, or otherwise as required by law. Patlytics is based in the United States. The Services are controlled and operated by us from theUnited States and are not intended to subject us to the laws or jurisdiction of any state, country orterritory other than that of the laws of the country(ies) where the Services are controlled. Byusing our Services, you understand and acknowledge that your Personal Information will betransferred from your location to our facilities and servers in the United States. By using theServices, you consent to the transfer of information to countries outside of your country ofresidence, including the United States, which may have data protection rules that are differentfrom those of your country.

Legal Basis for Processing

Our legal bases for processing your Personal Information include:Performance of a Customer Agreement with a Customer when we provide and maintain ourServices. When we process Account Information, Customer Content, and Technical Information solely to provide our Services to you, this information is necessary to be able to provide ourServices. If you do not provide this information, we may not be able to provide our Services to you.Our legitimate interests in protecting our Services from abuse, fraud, or security risks, or in developing, improving, or promoting our Services. This may include the processing of AccountInformation, Non-Customer Content (as defined in our Terms and Conditions), SocialInformation, and Technical Information.Your consent when we ask for your consent to process your Personal Information for a specific purpose that we communicate to you. You have the right to withdraw your consent at any time.Compliance with our legal obligations when we use your Personal Information to comply with applicable law or when we protect our or our affiliates’, users’, or third parties’ rights, safety, and property.

Privacy rights

The laws of certain jurisdictions may provide data subjects with various rights in connection withprocessing of Personal Information, including:

  • The right to withdraw any previously provided consent;
  • The right to access certain information about you that we process;
  • The right to have us correct or update any Personal Information;
  • The right to have certain Personal Information erased;
  • The right to have us temporarily block our processing of certain Personal Information;
  • The right to have Personal Information exported into common machine-readable format;
  • The right to object to our processing of Personal Information in cases of direct marketing, or when we rely on legitimate interests as our lawful basis to process your information; and

Under the laws of certain jurisdictions, when processing personal data of authorized users in connection with the provision of Services to our Customers, we may be deemed a “data processor” while our Customers are deemed “data controllers”. Where we are deemed a data processor, authorized users should contact our Customer, the data controller, to pursue any such legal data subject rights. We will reasonably cooperate with our Customers to support and comply with any such data subject rights requests.

Data Transfers: Where required, we will use appropriate safeguards for transferring PersonalInformation outside of the EEA, Switzerland, and the UK. We will only transfer PersonalInformation pursuant to a legally valid transfer mechanism.

Changes to the Privacy Policy

We reserve the right to change this Privacy Policy at any time. When we do, we will post an updated version on this page, unless another type of notice is required by applicable law. You are responsible for periodically reviewing this Privacy Policy to check for any changes. Changes to this Privacy Policy are effective when they are posted on this page. By continuing to use ourServices or providing us with Personal Information after we have posted an updated PrivacyPolicy, or notified you by other means, you consent to the revised Privacy Policy.
